Abstract
Sexual violence against children constitutes a grave human rights violation with profound and lasting psychological trauma. The Supreme Court Decision Number 5642 K/Pid.Sus/2022 confirms the death penalty for Herry Wirawan, a religious teacher who committed sexual violence against thirteen underage female students. This study employs normative legal research using library research methods to analyze the decision from two perspectives: international human rights law and Islamic criminal policy (siyasah jinaiyyah). The results show, first, that the judges' considerations integrated fair trial standards under Article 14 ICCPR and Article 28J paragraph (2) of the 1945 Constitution, while simultaneously aligning with the concepts of maslahah mursalah and the protection of Maqasid al-Shari'ah, particularly hifz al-nafs (protection of life) and hifz al-nasl (protection of lineage). Second, the imposition of the death penalty reveals both convergence and tension between the two perspectives. From the perspective of international human rights, the UN Human Rights Committee in General Comment Number 36 of 2019 views the death penalty for crimes without direct loss of life as potentially inconsistent with Article 6 paragraph (2) ICCPR, yet this position is not absolutely binding on Indonesia, which has not ratified the Second Optional Protocol to the ICCPR. From the Islamic perspective, the defendant's actions qualify as jarimah ta'zir al-jara'im al-kubra, making the death penalty as ta'zir bi al-qatl legally valid. Both perspectives converge on the principle of proportionality, rendering this decision constitutional and consistent with siyasah syar'iyyah.
